      A senior Air Force enlisted member came to our office for a second opinion after he had signed a plea agreement with a different attorney to plead Guilty to a Federal charge of Distribution of Child Pornography. After reviewing the facts with him, and advising as to our thoughts on the case, he decided to terminate his other attorney and retained our firm. Mr. McCormack was then able to renegotiate the plea agreement with the US Attorney’s office, getting the prosecutor to reduce the charge from Distribution to Receipt. As the prosecutor discussed with Mr. McCormack during this process, she was extremely reluctant to reduce the charge, since she had already taken a position on the case and made a plea agreement with the prior attorney for Distribution. Once Mr. McCormack had secured the Receipt plea agreement, it was time to focus on sentencing – our client was facing many years in prison with a statutory minimum of 5 years, a statutory maximum of 20 years and Sentencing Guidelines that provided for a sentencing range of 210-262 months of confinement. To secure a sentence below the Guidelines, Mr. McCormack’s office staff prepared an extensive sentencing package consisting of background, family and career information as well as numerous character letters for presentation to the judge. At the sentencing hearing, the prosecutor requested a sentence within the Sentencing Guideline range (210 months up to the statutory max of 20 years). Mr. McCormack argued at length that the Sentencing Guidelines were excessive in all respects, that even the minimum guideline of 210 months (17.5 years) was ludicrous for this offense of receipt of child pornography and that the statutory minimum of 5 years would be an appropriate sentence in this case. The judge imposed a sentence of 5 years and 10 months. After imposing the sentence and recessing the court, the judge came off the bench to shake Mr. McCormack’s hand and complimented him on the outstanding sentencing package that he had presented to the court for our client.

      At the 15-year mark in my career as a Naval Officer, I had a clear vision of what the remainder of my active duty service would look like. I had just transferred to a sea duty command and I was in communication with my detailer regarding my final tour in the Navy. I spent the last two years working toward a degree in Electrical Engineering while working part time. Thanks to you and everyone who worked so diligently on my case, I now have only two years of school left and thanks to your knowledge of the legal system, the Board for Correction of Military Records ruled my original General Discharge to be overturned, giving me two years of E-5 back pay while I was attending school and giving me an RE-1 reenlistment code, allowing me to go back in the Navy in the future but putting me two years closer to retirement. At the arraignment, the key witness’s stories were dismantled further and put on record. Once the trial started, I saw how the jury members were closely scrutinized during voir dire ensure the best advantage to the defense. There was never a section of the trial where each detail was overlooked - every step of the way you took notes, researched, planned, and adjusted strategy to gain any possible advantage over the prosecution. During the trial, there were definitely periods where I thought the govt. was starting to get an upper hand, but once defense was up I felt like I was still doing okay. I must admit I was on the edge of my seat wondering if things were going to work out for me, but you just kept swinging and continued to bring doubt and show motives to the jury. I cannot express enough gratitude and appreciation for all the work you all did to win my case and allow me survive this ordeal. Even once the verdict was out and I was found guilty of 1 of 16 original charges, you treated sentencing like a whole other trial; fighting every detail to ensure I was afforded the opportunity at the best sentence possible.       Dear Greg, As I said to you when we walked outside of the courtroom after closing arguments and the jury went into deliberation: "No matter the outcome of this case, you did your job!       We first met you early this year from the start of the most horrific situation our family ever had to endure.       "They Gave Me Back My Life!"

      I have always believed that the United States military is one of the most proficient and intriguing paths for a young person establishing their selves in life. I firmly thought that the military would be exactly the foundation that I needed to create the life I have always desired. While the sentiments of the military being an outstanding institution remain true, I was regrettably wrong to think that military life was for me. After completing boot camp and only a month at my first duty station, I bought a plane ticket and flew home. I had no idea what the ramifications of my actions would be or what I would face for leaving. The only thing that I did know was that the military was not for me and that I was not going to stay. It was a full six months later before I realized that a warrant had been issued for my arrest by the military. I casually came across this information while applying for a job and my previously crystal clear background check now listed me as a felon. To say that I was devastated would be the understatement of the year. I fell into a state of depression and even contemplated suicide. With no knowledge of what I would be facing for my mistake, I knew I wanted my life back but had no clue as to how to fix the issues that I had created. I decided that if indeed I had to turn myself over to military control and spend whatever amount of time in a military jail that was ordered, then that was what I was ready to do. The thought of military jail time were less frightening then being an enlisted sailor. Based on advise from a friend, I went online to find attorneys in my local area to simply consult with to learn what I should do. Over a 3 month time span, I met on consultation visits with a total of "six lawyers that specialize in military law" in my immediate area. Every time these "military lawyers" left me with more questions as I walked in having. Each time I searched for a new lawyer to speak to, The Law Firm of McCormack and McCormack web site ad popped up. I immediately dismissed this ad simply because of where the attorney was based. I remember thinking that I had to find a local attorney that I can look at face to face to help me through this matter.       If you ever become caught up in the the military legal system, making the wrong choices could cause you to loose your career, your freedom and the respect of your peers. One of those decisions is knowing who to talk to and even more importantly knowing who not to talk too. It doesn't matter how innocent you are. The prosecutor representing the United States has one job and that is to prove you are guilty. They're resources are unlimited and will come at you with every asset at their disposal. I know this because I found myself caught up in this nightmare. My first wrong choice was to talk to the prosecutors figuring I had nothing to hide. That was my first mistake...they turned my statements against me and used them to compound the charges against me. My second wrong choice was my legal counsel. After 3 weeks of explaining what had happen in my case he still could not get the facts right. I ended up making the decision to fire him. That was my first right decision.       Dear Mr. McCormack, In February of this year, I received notice from my Commanding Officer that I was the subject of an investigation into allegations that I made sexually offensive statements to some crew members and was being removed from the ship to allow the investigation to take its course. Taken completely aback by the news, I was given the advice to seek legal counsel. My first inclination, I must admit, was to seek out a JAG attorney. During an internet search about the UCMJ articles containing the charges I was being investigated for, I found a link to your website. After reading the testimonials from past cases, I was interested in seeking further information and made an appointment to meet with you the very next day. From that first meeting and on throughout this process, the advice and direction that you provided not only prevented me from making some mistake that could potentially destroy my case, but also kept hope alive for my entire family that we might actually be able to fight these allegations. In March, at the conclusion of the investigation, my Commanding Officer felt that the statements of the accusers were sufficient evidence to proceed to NJP and I was ordered to appear. Over the past two days my wife and I watched your incredible litigation skills in action as you seemed to bend the room to your will.
